Terms of Service

These Terms of Service (“Terms”) govern your access to and use of LaunchDNA AI (“the Service”), operated by LaunchDNA AI (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

LaunchDNA AI is an AI-powered platform that helps users create launch-ready digital products. The Service generates niche research, manuscripts, brand packs, sales listings, pricing recommendations, and marketplace-ready bundles using artificial intelligence. Products can be published to third-party marketplaces such as Whop.

2. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate and complete information when creating your account and keep it up to date.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Intellectual Property

Your Content

You retain ownership of the input you provide to the Service (topics, instructions, preferences). AI-generated content (manuscripts, listings, brand packs, pricing recommendations) is produced for your use. You are granted a perpetual, non-exclusive license to use, modify, distribute, and commercialize all AI-generated content created through your account.

Our Platform

The Service, including its design, software, algorithms, branding, and documentation, is owned by LaunchDNA AI and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

5. AI-Generated Content

  • AI-generated content is produced by machine learning models and may contain inaccuracies. You are responsible for reviewing and verifying all generated content before publishing or distributing it.
  • We do not guarantee that AI-generated content is original, unique, or free from similarity to other works.
  • You are solely responsible for ensuring that your use of generated content complies with applicable laws, including intellectual property and advertising regulations.

6. Payment and Billing

  • The Service offers free and paid tiers. Paid features require a valid payment method processed through Stripe.
  • Prices are listed in US Dollars unless otherwise stated. We may change pricing at any time with reasonable notice to existing subscribers.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • Refunds are governed by our Refund Policy. All plans include a 30-day money-back guarantee.

7. Marketplace Publishing

The Service allows you to publish digital products to third-party marketplaces (currently Whop). You are solely responsible for:

  • Ensuring your published products comply with the marketplace’s terms of service
  • The accuracy and legality of your product listings
  • Customer support for buyers of your published products
  • Tax obligations arising from sales of your products

We are not a party to transactions between you and buyers of your products.

8. Prohibited Uses

You agree not to use the Service to:

  • Generate or distribute content that is illegal, harmful, defamatory, or infringes on the rights of others
  • Misrepresent AI-generated content as human-written where such disclosure is required by law or platform rules
  • Attempt to reverse-engineer, scrape, or extract our AI models or algorithms
  • Create accounts using automated methods or operate multiple accounts to circumvent tier limits
  • Interfere with the security or availability of the Service
  • Resell, sublicense, or white-label the Service itself (you may sell products you create using the Service)

9. Limitation of Liability

To the maximum extent permitted by law, LaunchDNA AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will meet your specific requirements or expectations.

11. Termination

You may delete your account at any time through the Settings page or by contacting us. We may suspend or terminate your account if you violate these Terms, with or without notice. Upon termination, your right to use the Service ceases, and we may delete your data in accordance with our Privacy Policy.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Delaware.

13. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
